1.1 In these General Terms and Conditions, the following definitions shall apply:
Doctorcura: Doctorcura, a company duly incorporated under Dutch law, operating an online health platform accessible via www.doctorcura.com.
Client: The natural person who makes use of the Services offered via the Doctorcura platform.
Services: The treatments and related services offered through the Doctorcura platform, including the facilitation of medical consultations with independent physicians and the supply of medicinal products via registered pharmacies.
Treatment: Any medical or health-related program or intervention offered through the platform.
Agreement: The agreement entered into between Doctorcura and the Client regarding access to and use of the Services.
Partner Pharmacy: A pharmacy registered within the European Union that supplies medicinal products on the basis of a valid prescription issued by a licensed physician. Any purchase agreement for prescription medicines is concluded directly between the Client and the Partner Pharmacy.
Prescriber: An independent, duly licensed and registered physician who offers medical services through the Doctorcura platform.
Terms: These general terms and conditions, together with all information and documents expressly referred to herein.
2.1 These Terms apply to all offers, Agreements and Services of Doctorcura, as well as to services provided by independent Prescribers and Partner Pharmacies operating via the Doctorcura platform. Any deviation from these Terms shall be valid only if expressly agreed upon in writing.
2.2 By using the Services, the Client confirms that they have read, understood and accepted these Terms.
3.1 Doctorcura operates an online platform that enables Clients to access Treatments offered by independent Prescribers and, where applicable, medicinal products supplied by Partner Pharmacies.
3.2 Doctorcura does not provide medical, pharmaceutical or healthcare services itself. Doctorcura acts solely as a technical and administrative intermediary facilitating access to services offered by independent third parties.
3.3 Any medical consultation or Treatment is provided exclusively by independent, registered physicians who offer their services through the platform. A treatment agreement is concluded directly between the Client and the Prescriber.
3.4 Medicinal products are supplied solely by registered European pharmacies on the basis of a valid prescription issued by a Prescriber. Any purchase agreement for medicinal products is concluded directly between the Client and the Partner Pharmacy.
3.5 Doctorcura does not guarantee that a Client will be eligible for any Treatment or prescription. There is no entitlement to a medical prescription.
3.6 The presentation of Treatments or Services on the platform is for informational purposes only and does not constitute a binding offer. Any selection made by the Client represents a non-binding preference and does not bind the Prescriber or Partner Pharmacy.
3.7 Doctorcura does not guarantee any specific medical, therapeutic or personal outcome. Results may vary per individual.
3.8 Doctorcura reserves the right to modify, suspend or discontinue any part of the Services at any time. Any prepaid amounts for Services not yet rendered will be refunded where applicable.
3.9 The Client acknowledges and agrees that the Services and any medicinal products are not reimbursed by health insurers. The Client expressly waives any right to reimbursement from an insurer for costs incurred through the platform.
4.1 To use the Services, the Client must create a personal account via the Doctorcura website.
4.2 The Client may maintain only one account and must be at least 18 years of age.
4.3 The Client is responsible for ensuring that all information provided is complete, accurate and up to date, for safeguarding login credentials, and for all activities conducted via their account.
4.4 Doctorcura may suspend or terminate an account if these Terms are violated or if misuse of the platform is suspected.
5.1 Doctorcura does not supply medicinal products itself. Partner Pharmacies deliver medicinal products directly to the Client.
5.2 Any purchase agreement for prescription medicines is concluded solely between the Client and the Partner Pharmacy and is governed by the pharmacy’s own terms and conditions.
5.3 Payment for prescription medicines may be included in a subscription or treatment fee paid to Doctorcura; however, this does not alter the direct contractual relationship between the Client and the Partner Pharmacy.
5.4 Medicinal products are shipped by certified courier services. Delivery times may vary due to exceptional circumstances such as supply shortages.
5.5 Delivery is deemed completed upon transfer of the medicinal products to the courier.
5.6 Medicinal products are intended for personal use only and may not be resold or transferred to third parties.
6.1 The Client shall not impersonate another person or use false or misleading identity information.
6.2 The Client must provide complete, truthful and accurate medical information to Prescribers via the platform.
6.3 The Client must promptly inform Prescribers of any changes in their health condition.
6.4 The Client shall strictly follow medical advice and instructions relating to Treatments and medicinal products.
6.5 The Client is responsible for informing their general practitioner of any Treatments or medications obtained through the platform.
6.6 The Services are not intended for emergency situations. In the event of an emergency, the Client must contact their general practitioner, emergency medical services or the nearest hospital.
6.7 For general questions or non-medical issues, the Client may contact Doctorcura via contact@doctorcura.com. Medical questions will be referred to the relevant Prescriber.
7.1 Prices for Services are displayed on the Doctorcura website and include applicable taxes, service fees and, where relevant, shipping costs.
7.2 Payment must be made in advance unless expressly agreed otherwise.
7.3 Subscription-based Treatments are charged according to the schedule communicated at the time of purchase, typically in recurring cycles aligned with the Treatment or medication period.
7.4 The Client may pause, suspend or cancel a subscription via their account or by contacting contact@doctorcura.com.
7.5 In the event of late payment, statutory interest and reasonable collection costs may be charged.
7.6 If a Service cannot be provided, Doctorcura will refund any amounts paid for the undelivered Service within a reasonable timeframe.
8.1 The Client has the right to withdraw from the Agreement within 14 days of its conclusion, unless the execution of the Services has commenced with the Client’s explicit consent.
8.2 If a medical consultation has already taken place or medicinal products have been dispatched, the right of withdrawal lapses due to the nature of the Services and products.
9.1 Where expressly stated on the platform, a limited money-back guarantee may apply to specific Treatments under the conditions described at the time of purchase.
9.2 Any such guarantee applies once per Client and solely to the first Treatment purchase.
9.3 The decision to grant a refund rests exclusively with Doctorcura, based on verified information and compliance with the stated conditions.
10.1 Doctorcura is not liable for damages resulting from failure to follow medical advice or incorrect use of medicinal products.
10.2 To the maximum extent permitted by law, all warranties and conditions, whether express or implied, are excluded.
10.3 Doctorcura’s liability is limited to the amount paid by the Client for the relevant Service.
10.4 Doctorcura is not liable for acts or omissions of Prescribers or Partner Pharmacies, who remain solely responsible for their professional services.
10.5 Doctorcura is not liable for damage resulting from technical failures, service interruptions or force majeure events.
11.1 Doctorcura may terminate or suspend the Agreement or access to the Services at any time and for any reason.
11.2 Doctorcura may amend these Terms. If the Client objects within two weeks of notification, Doctorcura may terminate the Agreement without further obligation.
12.1 Personal data is processed in accordance with applicable data protection laws, including the General Data Protection Regulation.
12.2 The Client consents to the collection, processing and sharing of personal and health data with Prescribers and Partner Pharmacies insofar as necessary for the provision of the Services.
12.3 The Privacy Policy forms an integral part of these Terms.
13.1 Doctorcura uses cookies to enhance website functionality and user experience.
13.2 Third-party analytics and advertising services may be used. Cookies do not contain directly identifiable personal information. Further details are provided in the Privacy Policy.
14.1 Complaints must be submitted in writing via contact@doctorcura.com.
15.1 Doctorcura may assign its rights and obligations under the Agreement to third parties.
15.2 The Client may assign rights or obligations only with Doctorcura’s prior written consent.
16.1 Doctorcura reserves the right to amend these Terms. Amendments will be communicated via the website or by email.
16.2 If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
